Key Developments in the Case Involving Former Leaders
In a significant development, police are expected to start recording statements from former Prime Minister KP Sharma Oli and former Home Minister Ramesh Lekhak beginning on Tuesday. This decision comes after obtaining court approval to keep them in custody for five days as part of an ongoing investigation.
According to Senior Superintendent of Police Ramesh Thapa, who is the Kathmandu Police Chief, investigators are working to gather more evidence. The focus of the investigation is on the report issued by a commission that probed the events surrounding the September Gen Z movement.
“The arrest of these individuals was made to implement the findings of the commission,” Thapa said. “As a result, the process of recording their statements is expected to begin on Tuesday. Investigating officers are currently making all the necessary preparations.”
Despite this, officials have not yet finalized the method for recording the statements, taking into account health and security concerns. Some questioning will be based on existing evidence, and preparations are currently underway.
Current Status of the Arrested Individuals
Oli is currently receiving medical treatment at Tribhuvan University Teaching Hospital. Meanwhile, Lekhak is being held at the Nepal Police Battalion No. 2 in Maharajgunj.
During a recent hearing, Oli was presented for a remand extension. In contrast, Lekhak appeared in court on his own accord.
A commission led by former judge Gauri Bahadur Karki recommended legal action against both Oli and Lekhak under Sections 181 and 182 of the National Penal (Code) Act, 2074.
Legal Implications of the Charges
Section 181 of the law prohibits causing death through negligent acts. If found guilty under this section, the penalties include a prison term ranging from three to ten years, along with a fine between Rs 30,000 and Rs 100,000.
Section 182, on the other hand, bars causing death through reckless conduct. The punishment for this offense includes up to two years in prison and a fine of up to Rs 30,000.
These charges carry serious legal consequences, and the outcome of the investigation could significantly impact the future of the individuals involved.
Ongoing Investigation and Next Steps
The investigation is still in its early stages, and several key steps remain before any final conclusions can be drawn. Police are working closely with legal experts to ensure that the process is conducted fairly and transparently.
The next phase of the investigation will involve detailed questioning of both Oli and Lekhak. Their statements will play a crucial role in determining the course of legal proceedings.
As the situation unfolds, it is likely that further updates will be released by the authorities. The public and media will be closely watching the developments in this high-profile case.
